These Terms and Conditions govern your use of our website and the purchase of products from The English Colouring Book Company.

2. Products

 

We design, manufacture and sell creative products, including watercolour kits, colouring products, art books, instructional books and related materials.

 

We make every effort to ensure that product descriptions, specifications, photographs and other images shown on our website are accurate. However, colours and appearance may vary slightly due to screen settings, printing processes and the nature of the materials used.

 

Product packaging, presentation and minor design details may occasionally differ from those shown on our website, provided that such changes do not materially affect the product's quality, function or overall character.

3. Orders

 

All orders are subject to acceptance and product availability.

 

After placing an order, you will receive an email confirming that we have received your order. This acknowledgement does not necessarily mean that your order has been accepted. A contract between you and The English Colouring Book Company is formed when we accept your order and begin processing it for dispatch.

 

We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, there has been an error in the price or product information, payment has not been authorised, or we reasonably suspect fraudulent activity.

 

If we cancel an order after payment has been taken, we will refund any amount paid to the original payment method.

4. Pricing

 

All prices are displayed in Pounds Sterling (£) and show the total price payable for the product. Delivery charges, where applicable, will be shown separately before you complete your order.

5. Payment

 

We accept payment using the payment methods made available at checkout. Available payment methods may change from time to time.

 

Payment must be received and successfully authorised before an order is processed for dispatch.

 

All payments are subject to the terms and conditions of the relevant payment provider.

6. Delivery

 

We aim to dispatch orders within 2 working days of receiving your order.

 

Estimated delivery times following dispatch are:

• UK: 3 to 5 working days

• USA: approximately 8 working days

• International: approximately 8 -15 working days

 

Delivery times are estimates only and are not guaranteed. International deliveries may take longer due to customs clearance, local postal services or other circumstances outside our reasonable control.

 

Any applicable delivery charges will be displayed at checkout before you complete your order.

 

Please ensure that the delivery address provided when placing your order is complete and accurate. We cannot accept responsibility for delays or failed delivery resulting from incorrect or incomplete address information provided by the customer.

7. Customs and Import Charges

 

For orders delivered outside the United Kingdom, customs duties, import taxes, VAT and other charges may be imposed by the destination country.

 

Unless expressly stated otherwise at checkout, these charges are not included in the product price or delivery charge and are the responsibility of the customer.

 

The English Colouring Book Company has no control over these charges and cannot predict their amount. Customers are responsible for complying with any applicable import requirements in their country.

8. Returns and Refunds

 

Customers may cancel their order and request a return within 14 days of receiving their order. Once a return has been requested, the product must be returned to us within a further 14 days.

 

Products must be returned unused and in their original condition. Customers are responsible for the cost of returning unwanted products.

 

If a product is faulty, damaged or incorrect, please contact us as soon as possible. In these circumstances, The English Colouring Book Company will cover reasonable return postage costs and will offer a replacement or refund as appropriate.

 

Refunds will be issued to the original payment method once the returned item has been received. We may make a reasonable deduction from the refund if the product has been handled beyond what is necessary to establish its nature, characteristics and condition.

 

Where an entire order is cancelled, we will also refund the standard delivery charge originally paid. Any additional amount paid for an enhanced or express delivery service is non-refundable.

 

Nothing in these Terms and Conditions affects your statutory rights.

9. Faulty or Damaged Goods

 

If your order arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible. Where appropriate, we may ask you to provide photographs of the product and/or packaging to help us understand and resolve the issue.

 

Depending on the circumstances, we will offer an appropriate remedy, which may include a replacement, repair or refund.

 

Where a product is faulty, damaged or not as described, we will cover any reasonable costs of returning the product to us.

 

Nothing in these Terms and Conditions affects your statutory rights.

10. Intellectual Property

All content on our website, including artwork, designs, text, graphics, logos, and product designs, remains the property of The English Colouring Book Company.

No content may be copied, reproduced, distributed, or commercially used without written permission.

11. Limitation of Liability

 

All content made available through our website and products, including artwork, illustrations, designs, text, graphics, photographs, logos, branding and product designs, is protected by intellectual property laws.

 

Such content is owned by The English Colouring Book Company, its partners, contributing artists or other licensors, as applicable, and is used by The English Colouring Book Company with the appropriate rights or permissions.

 

Our products and the artwork contained within them are supplied for personal, non-commercial use unless otherwise expressly agreed in writing.

Purchasing a product does not transfer ownership of any copyright or other intellectual property rights in the artwork or content.

 

Customers are welcome to complete, colour or paint the artwork for their own personal enjoyment, to give their completed physical artwork as a gift, and to share photographs of their completed work, including on social media.

 

You may not reproduce, scan, copy, digitally distribute or otherwise reproduce the original artwork or designs. Completed artwork may not be reproduced, printed onto other products, used for commercial purposes or offered for sale without prior written permission from The English Colouring Book Company or the relevant rights holder.

 

Our artwork, illustrations, designs and other protected content may not be used to create or develop products for sale or other commercial purposes without prior written permission.

12. Governing Law

 

These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales.

 

If you are a consumer resident in another part of the United Kingdom, you will also benefit from any mandatory protections provided by the laws of the country in which you live and may be entitled to bring proceedings in your local courts.

 

If you are a consumer outside the United Kingdom, nothing in these Terms and Conditions affects any mandatory rights or protections you may have under the laws of your country of residence.
